KASHKIND PRIVACY POLICY
KashKind Ltd (“we”, “us”, “our”, “KashKind Ltd”) take data protection very seriously and we are committed to taking care of your business data and any data that may be used to identify individuals (“personal data”) in the course of operating the KashKind Ltd service (“Service”).
This Privacy Policy (“Privacy Policy”), which includes our (“Cookie Policy”), sets out the basis on which we will collect, process, store and disclose personal data as a controller under the Data Protection Act 1998/2018 (including the General Data Protection Regulation (EU) 2016/679, and any replacement statute from time to time (the “DPA”).
Capitalised terms not otherwise defined in this Privacy Policy shall have the meaning given to them in your contract with us for the supply of the Service (the “Service Agreement”), of which this Privacy Policy forms part, or the DPA.
The Service Agreement and the Privacy Policy determine our responsibilities under the DPA.
By using our Services, you agree to grant us a royalty-free, transferable, sub-licensable, license to use your personal data for the purposes and on the basis set out in this Privacy Policy.

1. The information we collect
We only collect personal and business data relevant to your finance applications via the Service. Such personal data may be given directly by you or by others authorised to act or share such information on your behalf. The table in Annex A specifies the personal data we collect, the relevant purpose and the legal basis for processing.
To keep your personal information up-to-date, please advise us of any changes by e-mail to support@kashkind.com, and as soon as possible after any change in your name, residential address, telephone number, e-mail address and any other such important details.
2. Disclosure of your information
We will keep your personal data confidential and only disclose it to others for the purposes explained in Annex A.
3. Processing of personal data not provided to us by you
We may receive personal data from existing or prospective providers of finance to you (“Financial Service Providers”) in the course of considering whether to make an application or making an application to them.
We and the Financial Service Providers will also check your details with a fraud prevention agency/agencies and if you give false or inaccurate information and we identify fraud, this will be recorded and may be shared by those agencies with other organisations and us, so that we and other organisations, including law enforcement agencies and debt collection agencies, may access, use and search these records to:
1. Help make decisions about credit and credit related services, for you and your business.
2. Trace debtors, recover debt, prevent fraud, and to manage your accounts or insurance policies;
3. Prevent fraud and money laundering, for example, when:
o Checking details on applications for credit and credit related or other facilities;
o Managing credit and credit related accounts or facilities;
o Checking details on proposals and claims for all types of insurance; and
o Checking details of job applicants and employees.
You acknowledge that credit reference agencies link together the records of you and anyone that you have advised is a financial associate (e.g. someone with whom you have a joint credit account) including previous and subsequent names of parties to the account. Links between financial associates will remain on your, and their, credit reference files until such time as you or your partner successfully files for a disassociation with the credit reference agencies. When assessing the affordability of your repayments, we may take into account information about your financial associates in your credit reference.

4. Use of Personal Information
We may use the personal data we hold in one or more of the following ways explained in Annex A to this Policy.
5. Where and how we store your personal data
We will take all steps reasonably necessary to ensure that your personal data is treated and stored securely and in accordance with this Privacy Policy. When we receive your personal data, we will use (and require our suppliers to use) procedures and security features to try to prevent unauthorised and unlawful access and processing, as well as accidental loss or destruction of, or damage to it. Transmission of information, however, is not completely secure and, while we will do our best to protect your personal data in the course of transferring it ourselves, we cannot guarantee the security of your data when it is send to us and any such transmission is at your own risk.
We currently store the personal data described in Annex A in the UK, but you acknowledge and agree that personal data may be transferred to, and stored at, any destination(s) outside the UK including outside the European Economic Area ("EEA") and may be processed by staff operating outside the EEA who work for us or for one of our suppliers. Such staff may be engaged in, among other things, the provision of customer support or other services (such as data processing and analysis). We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.
Your personal data will be stored for the duration of the Service Agreement and for such time thereafter as required by Applicable Law or the limitation period for bringing contractual claims under or in relation to the Service Agreement.
6. Your rights
The table in Annex B to this Privacy Policy explains your rights under the DPA and how to exercise them. This Privacy Policy provides confirmation of the details required in relation to your right of access.
The Service may contain links to and from the websites of other service providers who may have their own privacy policies. Where you follow those links we do not accept any responsibility or liability for how those service providers collect, use, process, disclose or store your personal data. Please check their privacy policies before you submit any personal data directly via those websites or to those third parties.
This Privacy Policy shall be governed by and construed in accordance with English law and the parties agree that the courts of England shall have exclusive jurisdiction to decide any dispute arising under it, except that you may bring proceedings in the courts of Northern Ireland or Scotland if you are resident in either of those jurisdictions.

• To check any instructions given to us, for training purposes, for crime prevention and to improve the quality of our customer service;

• To develop and improve the Service;
• To ensure that content on the Service is presented in the most effective manner for you and for your device(s) from which we support access to the Service;
To disclose to the following third parties:
• To Finance Providers to whom you are making an application for finance via the Service;
• To a credit reference agency to check your identity and to prevent fraud, (it will also keep a record of your request and use it whenever anyone applies to be authenticated in your name);
• To our agents and subcontractors to use for the purpose of operating the Service, including customer support and providing services to us;
• To investigate, prevent or detect fraud or carry out checks against money laundering;
• To organisations providing a centralised application matching service which they collect from and about credit applications, for the purpose of preventing and detecting fraud;
• For audit purposes and to meet obligations to any relevant regulatory authority or taxing authority.
• If we sell or buy any business or assets, in which case it may disclose your personal data to the prospective seller or buyer of such business or assets, and personal data held by us will be an asset transferred;
• If we must disclose your personal data to comply with any legal obligation, enforce any agreements to which you are a party, protect our rights, property, safety or that of our other customers or third parties (for example for protection against fraud and reducing credit risk);
• To comply with a current judicial proceeding, a court order or legal process served on us or our Service, any request by the FCA or any other regulator who may have jurisdiction over us from time to time or for audit purposes and to meet obligations to any relevant regulatory authority or taxing authority; (b) processing is necessary for the performance of a contract to which you are party or in order to take steps at your request prior to entering into a contract;

Your Rights and How to Exercise Them Exception
Right of Access: To obtain from us confirmation as to whether or not personal data concerning you are being processed, and, where that is the case, access to the personal data and the following information: (a) the purposes of the processing; (b) the categories of personal data concerned; (c) the recipients or categories of recipient to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations; (d) where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period; (e) the existence of the right to request from the controller rectification or erasure of personal data or restriction of processing of personal data concerning the data subject or to object to such processing; (f) the right to lodge a complaint with a supervisory authority; (g) where the personal data are not collected from the data subject, any available information as to their source; (h) the existence of automated decision-making, including profiling, referred to in Article 22(1) of the GDPR and (4) and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.

This Privacy Policy provides confirmation of the details required in relation to your right of access.
Under the DPA, you have a right to access certain personal records that we hold about you. Any access request may be subject to a fee to meet our costs in providing you with details of the information we hold about you if the request is unfounded or excessive. Right to rectification: to obtain from us without undue delay the rectification of inaccurate personal data concerning you.
We must communication to each recipient to whom the rectified personal data have been disclosed, unless this proves impossible or involves disproportionate effort.

Right to erasure: to obtain from us the erasure of personal data concerning you without undue delay where:
(a) the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;
(c) you object to the processing based on legitimate interest where there are no overriding legitimate grounds for the processing;
(d) the personal data have been unlawfully processed;
(e) the personal data have to be erased for compliance with a legal obligation to which we are subject.
We must communication to each recipient to whom the erased personal data have been disclosed, unless this proves impossible or involves disproportionate effort.

Processing is necessary for
(b) compliance with a legal obligation which requires processing by Union or Member State law to which the controller is subject or for the performance of a task carried out in the public interest or in the exercise of official authority vested in us; or
(e) the establishment, exercise or defence of legal claims.
Right to request the restriction of processing concerning you: to obtain from us restriction of processing where:
(a) the accuracy of the personal data is contested by you, for a period enabling us to verify the accuracy of the personal data;
(b) the processing is unlawful and you oppose the erasure of the personal data and request the restriction of its use instead;
(c) we no longer need the personal data for the purposes of the processing, but it is required by you for the establishment, exercise or defence of legal claims;
(d) you object to the processing based on legitimate interest pending the verification whether our legitimate grounds override yours.
We must communication to each recipient to whom the restricted personal data have been disclosed, unless this proves impossible or involves disproportionate effort.

Where processing has been restricted under this right, such personal data shall, with the exception of storage, only be processed:
with your consent; or
for the establishment, exercise or defence of legal claims; or

The right to data portability: to receive the personal data concerning you which you have provided to us, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance from us, where:
(a) the processing is based on consent or is necessary for the performance of a contract to which you are party or in order to take steps at your request prior to entering into a contract; and
(b) the processing is carried out by automated means.
You have the right to have the personal data transmitted directly from us to another controller, where technically feasible.
The exercise of the right referred to in the first paragraph of this Article shall be without prejudice to the right to erasure.

The right to object to processing: to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on processing necessary for the purposes of the legitimate interests pursued by us or a third party (except where such interests are overridden by your interests or fundamental rights and freedoms which require protection of personal data), including profiling.

Where:
(a) we demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject; or
(b) or the establishment, exercise or defence of legal claims.
The right to ask us not to process your personal data for direct marketing purposes:
to object at any time to processing of personal data concerning you for such marketing, which includes profiling to the extent that it is related to such direct marketing.
You have the right to ask us not to process your personal data for marketing purposes. We will inform you if we intend to use, or disclose your information to any third party, for such purposes. You can exercise your right to prevent such processing by checking certain boxes on the forms used to collect your data.

The right not to be subject to automated individual decision-making, including profiling: to not be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.

If the decision:
(a) is necessary for entering into, or performance of, a contract between you and us;
(b) is authorised by Union or Member State law to which we are subject and which also lays down suitable measures to safeguard the data subject's rights and freedoms and legitimate interests; or
(c) is based on the data subject's explicit consent.
In the cases referred to in points (a) and (c) we shall implement suitable measures to safeguard the data subject's rights and freedoms and legitimate interests, at least the right to obtain human intervention on our part, to express his or her point of view and to contest the decision.
Terms of Service
Thank you for visiting KashKind Ltd
These terms and conditions (“Terms of Service”), which include our Privacy Policy, govern the use of the credit broking service (“Service”) provided by KashKind Ltd (“we”, “us”, “our”) to any business registered with us (“you”, “your”).
KashKind Ltd is incorporated in England & Wales with its registered office at 20-22 Wenlock Road, London (company number 11836604).
We are a finance introducer for UK registered Ltd companies, not a lender.
“Business Day” means any day which is not a Saturday, a Sunday or a bank or public holiday in England.
We only collect information from our clients with their permission, that is necessary to pass on to the Financial Service Provider (bank, Institutional Lender or Broker) for the purpose of the finance application. The processing of the application is done by the designated Financial Service Provider. KashKind may also run a credit check and verify information when required. Limitations of what we offer
Our Service is intended for your own business-related purposes only.
We do not provide debt counselling or debt advice. If you'd like support in this area, we suggest you contact Business Debtline.
We cannot guarantee that our Service will be successful for you, neither are we obliged to provide our Service to you.
Our Service is based on information from third parties over which we have no control, and may contain inaccuracies or errors.
Where you have not made us aware of your specific needs, it is your responsibility to ensure that any recommendations made through the Service meets your requirements.
Content and information provided as part of the Service may not be timely or correct, and will change without notice, meaning that it is for your general information and use only.
To support free usage of our Service, we must expressly exclude liability for any inaccuracies, service failures or errors to the fullest extent permitted by law. Accordingly, we cannot provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information offered through the Service.
To the extent permitted by applicable law, each party shall only be liable to the other party for any loss or damage which results as a directly foreseeable consequence of its breach of this Agreement or negligence (except in the case of fraud or willful misconduct).
Nothing in these terms shall seek to exclude or limit liability for death or personal injury or any other liability that cannot be lawfully excluded or limited.
While the Service is free of charge to you, we will receive commission from Financial Service Providers for introductions we make to them.
The Service is not intended as advice or to be relied upon by you in any way, including as the basis for making or not making any decision, and you should obtain your own independent financial, accounting, tax and/or legal advice concerning your activities in connection with the Service and any finance application and/or agreement.
You use and download information from the Service at your own risk and should use software to detect and disinfect viruses in any information you use and download.
The availability of third party sites, links, services or information via the Service does not constitute any recommendation, advice, endorsement or publication by us and we are not responsible for any such sites, links, services or information provided by any third party.
We reserve the right to change any aspect of the Service at any time without notice or to suspend access to the Service, or end it.
Your usage and responsibilities
By using the Service, you agree to notify us promptly of any changes in the details you have provided to us. You shall ensure that all information you provide to us is complete, true, up-to-date and accurate in all respects. You are solely responsible at your own cost and expense for creating backup copies and replacing any information you provide via the Service.
You agree that we and our Financial Service Lenders may carry out identity verification and credit checks on you and your owners or directors. You and your owners or directors acknowledge that credit reference agencies link together the records of you and anyone that you have advised is a financial associate (e.g. someone with whom you have a joint credit account) including previous and subsequent names of parties to the account. Links between financial associates will remain on yours, and their, credit reference files until such time as you or your associate successfully files for a disassociation with the credit reference agencies. We and any Finance Provider may take into account information about yours and your owners’ or directors’ financial associates in yours or their credit reference.
You agree to keep your username and password secure and when they are used to log-in we will assume that you are the person giving instructions and you will be liable for them unless and until you notify us that this is no longer the case. You are responsible for any activity through the Service arising out of any failure to keep your password secure. We may refuse or disable your access at our sole discretion without notice or explanation where it is lawful to do so.
If at any time you wish to cease using the Service, you may contact us to request deactivation of your account. Within a reasonable time of this notification, we will remove any third-party data access you may have given us. Historical data will be maintained by us as described below.
If you have agreed to pay us for any aspect of the Service, you recognise that we may withdraw your rights to use the Service as a result of non-payment.
You agree not to use the Service in a way that harms our reputation, and you agree to comply with all applicable laws and regulations, including the General Data Protection Regulations (GDPR).
You agree to indemnify and hold us, our staff, officers, group companies and partners harmless from loss, damage or claim, made by third parties and/or incurred as a result your breach of these terms.

Our intellectual property
You recognise that unless otherwise stated in writing we do not grant you any intellectual property rights in relation to the Service, which include copyright, database rights, our trademarks, domain names, design rights and patents.
In addition, the Service contains material which is owned by us or our licensors, including but not limited to source code, algorithms, databases, copy and graphics, and you recognise that unless otherwise stated in writing, we do not grant you any rights to these. You may only link to the home page of the Service. You must not display, frame or otherwise surround the contents or any page from the Service, or allow such content or page to be displayed framed or otherwise surrounded, with material not originating from us without our prior written consent.
You will not acquire any proprietary rights (including database rights) to any information provided via the Service.
You will not:
a. use the Service to:
i. collect any information of other users from the Service for the purpose of sending unsolicited communications outside the Service;
ii. create a database of information obtained from this Service otherwise than for your own records;
iii. transfer any information form the Service to any third party except where expressly permitted by us;
b. use automated scripts to collect information from or otherwise interact with the Service;
c. use the Service in any unlawful manner or in any manner that could harm the Service or the servers on which it is hosted;
d. register any person or entity on, or otherwise use, the Service without that person or entity's prior written authorisation;
e. impersonate any person or entity, create a false identity in relation to the Service or falsely state or otherwise mislead or deceive us;
f. remove any copyright or trade mark notice(s) from any material on or obtained via the Service.
Our management of data
We take data protection very seriously and we are committed to taking care of your business data in accordance with the provisions of our Privacy Policy.
As part of providing our Service to you our systems will gather data provided by you, in some instances from your systems such as accounting software, as well as from third-party sources.
As part of providing our Service to you we may share data provided by you with our panel of approved Lenders, and those Lenders will share with us information regarding your case such as its current status and outcome
Our usage of such data may involve interfacing to third party systems, to enhance the databases we use to provide the Service and our Services to others, and for monitoring of performance, statistical analysis and the identification of improvements to the Service.
By using our Services to provide data to us, you agree to grant us an irrevocable, royalty-free, sub-licensable, transferable, perpetual license to use, copy, reformat, translate, excerpt (in whole or in part) and distribute these data for any purpose on or in connection with the Service, to prepare derivative works of, or incorporate into other works. We may share this information with other third parties who assist us in providing the Service. In such circumstances, any data used will be anonymous and will not identify you as the source unless we receive your permission to do so. If you choose to remove your data, this license will expire, provided that you acknowledge (a) we may retain archived copies and (b) we are required to maintain records that are relevant to demonstrating our compliance with the Regulations for no less than five years from the date on which the records were created.
Client money
For the avoidance of doubt, KashKind does not hold or in any way handle any client monies whatsoever.
Complaints
If you want to make a complaint you can email support@kashkind.com with brief details of your complaint and your reference. We will acknowledge your complaint within three Business Days, then investigate and send you an initial response within another three Business Days. We will aim to resolve the matter within four weeks of receiving your complaint.
If within eight weeks after receiving a complaint we are still not able to resolve the matter, we will send you a final response
Other terms
We reserve the right to vary these terms and conditions at any time, including assigning these terms.
We may send any notices to you by email to the address provided when you signed up to the Service, or otherwise as updated by you through the Service. You agree that we may send you notices via email or via alerts within the service.
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain enforceable. Failure to exercise or enforce rights or provisions shall not constitute a waiver.
Your use of the Service is subject to English law, and we both agree to submit to the jurisdiction of the English courts to settle any dispute that might arise.

a. the name of the small or medium sized business;
b. the postal address, email address and telephone number of the business;
c. the amount of finance requested by the business (other than in relation to a request for a credit card account, unless the business has requested a credit card account with a specified limit);
d. the type of finance requested by the business (where a specific type of finance has been requested by the business);
e. the legal structure of the business (limited company, limited partnership, partnership sole trader, or other);
f. the period in years and months for which the business has been trading and receiving income;
g. the date by which the business requires finance or, if such date is not known, the date by which the business has requested finance.

What are cookies?
Cookies are small pieces of data stored on your browser, computer or other device when you visit websites, including our website (“our Website”). Cookies usually contain anonymous information which is accessible by the website which set it, on each later visit to that website or sometimes when you visit other websites.
